Joe Giudice has finally gotten his way. The Real Housewives of New Jersey husband’s request to lift a stay of removal  has been granted, can confirm — meaning he can finally leave ICE custody and head to his native Italy.

“The appeals court is in fact granting to lift the stay of removal,” an official at the Third Circuit Court exclusively told

According to records obtained by, Judge Cheryl Ann Krause gave her blessing on Thursday, October 3.

Just earlier today, a hearing on the matter was set for November 21 in Newark, New Jersey, court records indicated, but it appears there was a drastic change of plans.

But he's not across the Atlantic just yet. As of now, Joe is still behind bars at the gloomy Clinton County Correctional Facility in McElhattan, Pennsylvania, where the felon has called home since March. (He completed a three-year sentence for fraud crimes that month.)

"Mr. Giudice is currently in ICE custody pending removal," an ICE spokesperson told

A family source said he is likely to remain in the facility that has been accused of harboring sex abuse for at least a few more weeks.

“He will be there for a while. They will drag this out,” the source insisted. first revealed Joe, 49, was so desperate to leave a miserable ICE facility, he was willing to leave his wife Teresa and four daughters behind to live in Italy if his bond request was denied. Though Joe got his way this week, it is unlikely to leave the famous family with a happy ending.
