The Hollywood A-list couple made the announcement of their split on Friday.
"This is a personal and private matter for Katie and her family," Katie’s attorney Jonathan Wolfe told People magazine.
"Katie's primary concern remains, as it always has been, her daughter's best interest."
Tom's rep issued a statement shortly after the news broke saying, “Kate has filed for divorce and Tom is deeply saddened and is concentrating on his three children. Please allow them their privacy.”
Suspicions of the couple's impending breakup were raised recently because although Katie is always by her man’s side on the red carpet, she was notably absent from all of Tom’s Rock of Ages appearances around the world, spending the last few months in New York City with Suri, 6.
In fact, the last time the couple was photographed together was April 2012 in Baton Rouge, Louisiana where Tom was filming his upcoming movie Oblivion.
Tom and Katie welcomed their only child, Suri, in April 2006 and then were married that November in a Scientology ceremony at the Odescalchi Castle in Bracciano, Italy.
