Gabriel Aubry will not be charged for the incident involving his daughter Nahla’s nanny where he allegedly pushed the woman when she came to pick the little girl up.

Halle Berry and her ex have been in a vicious custody battle over their four-year-old daughter, but he will not be charged due to “insufficient evidence,” according to the L.A. City Attorney spokesman.

The nanny filed a police report following the January incident and Aubry had been investigated for misdemeanor battery and child endangerment.

As RadarOnline.com exclusively reported, a judge has ruled that Gabriel must have supervised visits with his daughter and he is not allowed to have overnight stays with Nahla.

Halle and Gabriel’s baby battle drama was amped up when she requested permission from the judge to move to France with her fiancé Olivier Martinez, because she fears for her safety after a recent threat from a deranged stalker. Aubry has vowed to fight his ex on this latest request.
