It's D-Day -- Lindsay Lohan Arrives At Court For Preliminary Hearing

UPDATE: 11:44 a.m. -- Sofia admitted that Lindsay's assistant called her on February 1, 2011 to try and return the necklace, the same day that the search warrant was issued – as RadarOnline.com first reported.

According to Sofia, Lindsay is the first customer to steal from the store in the three years it had been in business.

UPDATE: 11:32 a.m. – Sofia said on the day of the alleged theft, Lindsay put back on her own two necklaces – which didn't cover the allegedly stolen necklace from the store owners view, but made it hard for her to tell how many necklaces Lindsay had on.

UPDATE: 11:15 a.m. – Lindsay’s attorney is asking the jewelry store owner (Sofia Kaman) about the necklace and asked the D.A. if it is okay to refer to the necklace as “the missing necklace.” She was shot down by D.A. Danette Meyers who said, “No, it's People's exhibit #2.” Judge agreed, followed by the first bit of laughter in the court room.

A brown leather necklace and a Cartier necklace that Lindsay was wearing on the day of the alleged theft have just been admitted into evidence by Lindsay’s attorney, Shawn Holley.

UPDATE: 10:55 a.m. - Sofia said she paid $850 for the necklace. Sofia said she became distracted by Patrick, who was asking questions about the necklace while Lindsay wore it. Lindsay was in the store for 45 minutes. Lindsay didn't pay for the necklace, and they had no business agreement. Sofia said their store does not loan out jewelry. Sofia realized the necklace was missing 10 minutes after Lindsay left. According to Sofia, Lindsay said she would be back the next day to purchase a ring, but never showed up. Sofia went to the police the next day after Lindsay was a no-show.

UPDATE: 10:50 a.m. - Kaman says the mark-up on pieces of jewelry is 2-3 times the price they pay for it. On January 22, 2011 Lindsay came into store when only Kaman was working. There are four surveillance cameras in the store. Lindsay was looking at some rings, and some necklaces. DA Danette Meyers is showing the actual necklace that Lindsay allegedly took.

UPDATE: 10:41 a.m. – The store clerk has finished testifying as a witness. Kamofie & Company store owner, Sofia Kaman, is now taking the stand.

UPDATE: 10:36 a.m. - Clerk said she sent an email to the store owner that Lindsay had inquired about jewelry, but not making a purchase. The email DID state that Lindsay "forgot she had the earring in her ear." Clerk said Lindsay looked in the mirror with the earring on before she left the store. Lindsay had hair covering earring that she left on, the clerk said.

UPDATE: 10:25 a.m. – Lindsay’s attorney cross-examining the jewelry store clerk now. Holley asked if she is certain that Lindsay wasn't wearing earrings when she arrived at the store. Clerk says she can't be certain that Lindsay wasn't wearing her own earrings. Clerk testified that there was another person in store that day, and Lindsay's assistant Elinore, who was bringing her money.

UPDATE: 10:21 a.m. – Comsooksri said on January 18th, 2011 Lindsay came into store with a friend named Patrick. Lindsay inquired about an antique ring, but didn't purchase it. Lindsay asked about 18 karat white gold earrings worth $1,180. Lindsay tried them on. Clerk testified that Lindsay only gave her back one earring, but left the other earring on. Clerk said she told Lindsay to give back earring as Lindsay was about to leave the store. Clerk testifying she reviewed surveillance video from January 18, 2011 last night. No more questions from the District Attorney.

UPDATE: 10:13 a.m. - First witness, store clerk Tinelli Comsooksri, is being called to testify. Lohan’s attorney, Holley, said that she objected to testimony.

UPDATE: 10:06 a.m. – The female store clerk from Kamofie & Company is in the courthouse and will be testifying today.

UPDATE: 10:02 a.m. – District Attorney Danette Meyers has just entered the courtroom.

UPDATE: 10:00 a.m. – Michael Lohan is in the courthouse and has positioned himself in the front row, directly behind where Lindsay will be sitting with her council, Shawn Holley.

The troubled 24-year old Mean Girls star, who is accused of swiping a necklace from a Venice Beach jeweler, will be facing Judge Stephanie Sautner, who’ll decide if there is sufficient evidence for a jury trial to proceed against her in the felony theft case.

If ordered to stand trial, Lohan could automatically be found in violation of probation stemming from her 2007 DUI conviction -- and be sent to jail immediately, for up to six months.
