Kim Zolciak and Ex Kroy Accused of Blowing Off $300k Lawsuit Over Unpaid Loan as Money Troubles Worsen

Ex-Real Housewives of Atlanta star Kim Zolciak and her estranged husband Kroy Biermann have been accused of failing to show up to court despite being served with legal paperwork — and now the reality stars are facing being hit with a massive 6-figure judgment.
According to court documents obtained by RadarOnline.com, Simmons Bank has asked that a default be entered against Kim and Kroy for blowing off the case.
The lawsuit was filed on July 5, 2023, and the couple was served on August 16. Simmons Bank said the couple had until September 15 to respond but failed to do so.
As a result, Simmons has asked that a default be entered which is the first step in obtaining a default judgment against Kim and Kory.
As we first reported, in the lawsuit, Simmons Bank claimed the duo took out a Home Equity Line of Credit in the amount of $300k that had an original maturity date of December 2016.
The suit said Kim and Kroy modified the loan in August 2017 which extended the maturity date to December 2017. A second modification was executed in 2018 where the two acknowledged they owed $271k on the principal.
Simmons said Kim and Kory agreed to make monthly payments of $1,132.46 with the first payment due in February 2018 and the last payment due in January 2038.
In court documents, the bank accused the couple of defaulting on the loan. It said the last payment received was in October 2022.
Despite being notified of the debt, Simmons said Kim and Kroy refused to pay up on the unpaid balance. As a result, the bank has now demanded the entire amount owed on the loan be paid immediately.
Simmons said the estranged couple owes $213k plus interest of $1,700.
As RadarOnline.com first reported, the couple, who have been living under the same roof as their nasty divorce rages on in court, recently listed their Georgia mansion for $6 million.
The home is close to being foreclosed on and they are desperate to unload the property quickly.
As we previously reported, the reality stars have been hit with various lawsuits over the past couple of months over everything from debt to Target to an unpaid loan at a casino in the Bahamas.
The two were also hit with a massive tax lien by the Internal Revenue Service. The government said the couple owes $103,564.48 for 2013, $330,126.29 for 2017, and $714,143.90 for 2018. The grand total for their tax debt came to $1,147,834.67.
On top of their financial mess, cops have been called out to Kim and Kroy's home several times since their split to break up petty fights.
