Real Housewives of Beverly Hills star Erika Jayne’s husband Tom Girardi’s victims are facing another setback in court as they hunt for their missing millions.
According to court documents obtained by Radar, the trustee presiding over Girardi’s involuntary Chapter 7 bankruptcy is objecting to his creditors being allowed to go after Jayne.
The Bravo star is currently accused of helping her estranged husband embezzle money meant for the families of plane crash victims.
The orphans and widows were represented by Girardi in a case against Boeing. Another law firm was co-counsel and was the first to speak up about the alleged financial crimes. In court, the firm said Girardi failed to pay out $2 million owed to the families.
They accuse the once-respected L.A. lawyer of using the money to fund his lavish lifestyle with Jayne. Girardi and his law firm, who are accused of owing $101 million to various creditors, were forced into bankruptcy earlier this year. As a result, all legal matters against Girardi were put on hold.
A trustee as put in place to take control of Girardi’s finances and figure out the best way to pay back his numerous creditors. Recently, the law firm still representing the orphans and widows asked for permission to bring lawsuits against Jayne to try and collect. They argued she was not part of the bankruptcy.
The attorney representing the orphans and widows believed Jayne was in possession of assets they could seize. The firm said, “Edelson does not seek to obtain assets that ever belonged to estate. Instead, it seeks its own, traceable assets that were embezzled by Tom and potentially given to Erika. The automatic stay provides no protection to a third party in this circumstance.”
Now, the trustee is opposing the request saying she can handle it. She brings up the $25 million lawsuit she filed against Jayne as part of the bankruptcy.
The suit is demanding she return money her husband’s law firm used to pay the bills for her company EJ Global.
The trustee believes the money Girardi used could potentially have been embezzled. In court docs, she says if the law firm is allowed to go after Jayne it would “disrupt” their investigation. She is pleading with the judge to shut down the request arguing her investigation into Jayne is still in the beginning stages.
The judge has yet to rule on the matter.
