Could Britney Spears be freed from her father’s control?

As RadarOnline.com previously reported, the 37-year-old singer is “very upset” after her dad, Jamie, allegedly shook her son Sean Preston, 13, during a fight in his Los Angeles home on August 24 — and no longer wants him to be her conservator.

Now, it’s possible Jamie could be forced to step down from the vital legal role he has held for more than a decade, New York estate attorney Jules Martin Haas told RadarOnline.com in an interview.

A conservator “obviously has to act in an appropriate way," said the attorney, who does not work with the Spears family. "So if there are circumstances that a court would feel that would call into question the appropriateness for anyone for any reason to act as a guardian, whether that would be they committed a crime so to speak, the court most likely would have the power to revoke's someone’s conservatorship and appoint someone else that would be more appropriate."

Right now, charges have not been filed against Jamie, 67, who was accused of the violent behavior in a police report by his grandsons’ father, Britney’s ex-husband Kevin Federline.

The court will likely require more than just accusations, lawyer Haas pointed out.

“Allegations usually never enough,” the lawyer said. “Obviously, facts have to be presented to the court, and the court can make a decision. Like in any case, allegations are one thing, but charges are another.”

According to reports, Britney’s mother, Lynne, is interested in taking over the role, should Jamie have to step down.

While she could apply for the position, Haas noted, the court could also appoint an “independent person” to take on the job.

“The court could appoint an independent person, which happens very often, typically where there is acrimony in a family relationship, and people are fighting amongst themselves,” the attorney told RadarOnline.com.

The Spears family has been at odds for some time. In a hearing for a restraining order against Britney’s former manager Sam Lufti, Jamie admitted his relationship with his daughter was “strained.” (Britney and her family obtained a permanent restraining order against Lufti in June.)

Now, Britney is still recovering from her mental health treatment stint earlier this year, spending time with boyfriend Sam Asghari and sharing 30% custody of her sons with ex Kevin. (She also Shares Jayden James, 12, with her ex.)
