Custody of Judge and Simon's oldest child – Sidney Barney – has been one of the most contentious issues. The teen has been living with her dad since October 2013 and in December 2014 the Real Housewives of Orange County star’s ex asked the courts to make that a full-time, permanent arrangement. In shocking documents, Barney said their child developed “stomach cramping” and “felt extreme anxiety at her mother’s home…because of Tamra’s inappropriate behavior.”

“Child neglect” is one of the worst claims you can throw at a mother and Barney did that in spades in legal documents that were filed in March 2014. He alleged that Judge failed to look after their other two children – Spencer and Sophia, then 13 and eight – while they were in her care. The document says, the “neglectful” behavior has “resulted in the children not getting prompt medical care, nutritional meals, hygienic care and a deterioration in their school work and attendance.”

One example that Barney cited in court documents was an injury Spencer sustained when he “jammed his thumb.” The document alleges Judge failed to take their son to a doctor and when he finally received medical treatment – while in his dad’s care – “the thumb was later found to be broken.” But Judge denied the claims and in October 2014 a judge denied Barney’s request for sole custody, saying there was a lack of evidence to support his allegations.

Among the most outrageous claims in the bitter custody battle is the charge that Judge did not bathe Sophia and, at one point, the child was allegedly returned to Barney with unwashed hair, which had a bug in it. In one text message exchanged between the battling, bitter exes, Barney said, “She Sophia says you don’t shower her at night sometimes and then run late in the morning so there’s no time.” Again, the reality TV star denied the claims and the joint custody agreement remained in place in an October 2014 court decision.

In court documents Barney also claimed that – while in the reality star's care – their three children are not well fed. In charges that Judge denied, he wrote, “Additionally there is rarely any food in the home for the children to eat, as Respondent’s practice is to eat out. As a result of the instability, the children rarely have a nutritional meal at Respondent’s home, and are often sick.”

In his bid to obtain sole custody of their children, Barney claimed that Judge’s RHOC fame made the kids the target of school bullies. In court documents Barney, said, “These minor children are not going through the same issues as other minor children in their community. They are going through the same issues, exemplified with Respondent’s position in the spotlight. The children suffer from ridicule and bullying in school and isolation from their fellow peers.”

Barney also claimed that Judge was allegedly forging Sophia’s homework. He said in court documents, “Respondent’s neglectful behavior is evident in Sophia’s school homework, which is often incomplete and her attendance record in school. Petitioner learned that Respondent may have forged Sophia’s school reading logs.”

Sidney has been estranged from her mom ever since she moved out of Judge’s home and in with her father. In a letter submitted as evidence in Barney’s custody bid, the teen’s family therapist wrote, “She expressed she can’t trust predictability at her mother’s home, and never knows what to expect next.” The letter also says, “She is the daughter of a ‘high profile mother in the entertainment arena’ and that alone seems to bother her.”

Court documents revealed that a reunification counselor had been added to the custody case to try to build a bridge between mother and daughter. “The substantial danger the lack of therapy poses is that Tamra and Sidney’s relationship will not improve without continued therapy,” the documents said. “The therapy has proven successful thus far, however, her father is not allowing it to continue.”

In court documents obtained by RadarOnline.com it was alleged that Judge had only seen Sidney four times between October 2013 and February 2014. Referring to the strained relations between mother and daughter, Barney wrote in his court documents, “Their relationship needs repair and it will take some time.”
