Kim's Pain: Ex-Bodyguard Lawsuit Drags On 3 Years After Paris Robbery
Sept. 30 2019, Updated 7:20 p.m. ET
It has been three years since Kim Kardashian was held at gunpoint and robbed while in Paris for fashion week. While the Keeping Up With the Kardashians star still suffers from post-traumatic stress disorder, her ex-bodyguard continues to face the legal implications from the incident.
RadarOnline.com can exclusively reveal the negligence and beach of contract lawsuit against Pascal Duvier continues to drag on.
In court papers obtained from Van Nuys Courthouse, Kardashian’s insurance company AIG Property sued Duvier, his companies Protect Security Inc. and Belali Investments Inc., and Port Wilmington Maritime Society in October 2018 for $6,166,067.
An amended complaint was then filed against the Defendants on June 5, 2019. The amended complaint explained how the front gate to the courtyard of the No Address Hotel in Paris, France had a missing or broken lock, the intercom was not functioning and the concierge did not have any security training.
“Upon information and belief, prior to and including October 3, 2016, Defendants failed to address and/or correct these various security breaches,” the court papers read. “Defendants failed to inform the Insured of the above-mentioned various security breaches. On the evening of October 3, 2016, Defendants left the Insured in the Hotel alone without any security detail and/or bodyguard.”
The court papers explain how three masked men then entered through the unlocked front gate of the hotel and entered Kardashian’s suite.
“The masked men restrained the Insured and proceeded to rob her of her personal property, including one-of-a-kind jewelry,” the court papers read. “As a result of Defendants' failure to address and correct the various security breaches in the Hotel, failure to advise the Insured of these various security breaches in the Hotel, and leaving the Insured in her hotel room without personal protection and/or bodyguard services, upon information and belief, the masked men were able to enter the Hotel and rob the Insured of her personal property.”
As a result, Kardashian, 38, submitted a claim in the amount of $6,116,067.
On July 3, 2019, the Plaintiff requested to dismiss the case without prejudice against Protect Security, Port Wilmington Maritime Society and Belali Investments, Inc.
A Case Management Statement filed on July 3 revealed Belali Investments, Inc. and Port Wilmington Maritime Society have been dismissed from the lawsuit.
As for Duvier and Protect Security, Inc, the Defendants have been served, but have not appeared and have not been dismissed.
There is a Case Management Conference scheduled for October 18, 2019.
As RadarOnline.com readers know, the mother-of-four with husband Kanye West heard footsteps in her suite around 3am. She texted Duvier, who was guarding sisters Kourtney Kardahsian and Kendall Jenner while they were out.
Kardashian was bound, gagged and had a gun held to her head. The robbers fled the scene with $10 million worth of jewelry.
On an episode of Keeping Up With the Kardashians, she described the chilling attack.
“They asked for money, I said, ‘I don’t have any money,’" she explained. "They dragged me out to the hallway on top of the stairs. That’s when I saw the gun clear as day. I was like I have a split second in my mind to make this quick decision, am I going to run down the stairs and either be shot in the back… or if I make it and they don’t, if the elevator does not open in time or the stairs are locked, then I’m f****d. There’s no way out.”
She continued, “He grabs my legs and I had no clothes on under, so he pulled me towards him at the front of the bed and I thought, ‘Okay, this is the moment they’re going to rape me,’” she said. “I mentally prepped myself and then he didn’t, he duct taped my legs together. Then they had the gun up to me. I just knew that was the moment, they’re just going to shoot me in the head.”
After the incident, Duvier was let go from guarding the famous family.
Kardashian has changed her life drastically since the attack, as she refrained from posting her expensive jewelry on social media and has upped security.
