If Kevin Spacey thought he was off the hook after his accuser suddenly died amid a pending sexual assault lawsuit, he was wrong.

RadarOnline.com has exclusively learned that the case could continue despite the death.

“The estate of plaintiff can inherit the lawsuit and proceed,” civil litigator Allen Patatanyan, a founding partner of West Coast Trial Lawyers, told RadarOnline.com.

“This is not a simple process, however. The estate must have a court-appointed representative when the heirs petition the probate court. The same privacy concerns, to a lesser degree, that allow plaintiff to file anonymous lawsuits are still present when the plaintiff dies. So, more likely than not, the estate can proceed with the lawsuit as estate of John Doe.”

Legal eagle Genie Harrison, who represented the unidentified accuser, told RadarOnline.com in a statement that Spacey was "undignified, insensitive and inappropriate," to have filed the notice before the family had time to grieve.

As RadarOnline.com previously reported, the attorney who represented John Doe blasted the actor after his attorney team filed the notice of his death even thought he was asked not to until the family had time to grieve.

“Out of professional responsibility, we notified Spacey’s counsel of Mr. Doe’s passing. We explained our intent to allow his family more time to get past their immediate, paralyzing grief and begin settling his affairs before we filed a death notice with the court — which is our prerogative as his counsel," Harrison told RadarOnline.com. "Spacey ignored our request for compassion and filed the notice... without our consent."

“Mr. Doe was a dignified, kind, middle-aged man traumatized by Spacey’s alleged sexually depraved attack," Harrison added. "As a result of this case, other victims from around the world have reached out to our firm. Mr. Doe believed their harrowing stories, and in his final months he looked forward to standing up for all of them. His fight for justice is still very much alive."

In court documents obtained by RadarOnline.com, the masseur claimed Spacey grabbed his hand during a private massage two years prior, and made him touch his penis.

In May, a California federal judge allowed the case to move forward despite Spacey’s complaint that the plaintiff’s identity was being hidden.

The trial was set to begin on June 23, 2020.
