A big Happy Birthday for Joe Giudice!

The 49-year-old's last ditch effort to remain in the United States is going as planned.

According to court documents obtained by RadarOnline.com, a court order granted the petition to allow 27 former immigration judges to argue on his behalf before the Third Circuit Court judge.

In addition, Joe's petition for "a stay of removal" has also been granted until his case is seen before the judge.

"The petitioner’s motion for a stay of removal is granted. The requirements for granting a stay have been satisfied," the court documents stated.

"The Motion by '27 Former Immigration Judges, etc.' to proceed as amicus is granted."

As RadarOnline.com readers know, Joe has been hanging by a thread following a scathing argument by the attorney general who argued in a 15 page letter that the fraudster should be deported immediately.

For now this is a small victory for the jail bird.

Joe has attempted to appeal his deportation case twice before but to no avail.

Meanwhile, his wife Teresa — whom RadarOnline.com caught holding hands with a 26-year-old boy toy on a Miami getaway in February — recently admitted she will leave her husband if he’s deported.
