Joe Giudice’s worst nightmare has become a reality — his deportation appeal has been denied, RadarOnline.com can confirm.

"The Board of Immigration Appeals dismissed the case on April 11, 2019," The Executive Office for Immigration Review exclusively told RadarOnline.com.

"Please note that if the respondent disagrees with the BIA’s final decision, the respondent may file an appeal (“petition for review”) with the appropriate federal circuit court of appeals."

E! first reported Joe’s legal team already filed a petition for the federal court to review the decision, which his attorney confirmed to RadarOnline.com.

“We are extremely disappointed that the Board Of Immigration Appeals has denied Mr. Giudice’s appeal. We have filed a stay with the Third Circuit Court Of Appeals and will continue to fight to keep Mr. Giudice in the United States, the only country he knows, and reunite him with his wife and four daughters,” James J. Leonard Jr. said in a statement.

But if the court refuses to review the petition, he’ll have no choice but to leave the United States, where he has lived since he was a baby.

RadarOnline.com exclusively reported an immigration judge ordered Joe to be deported on October 10, 2018.

He filed an appeal in November, just before the deadline.

Joe was released from federal prison after a three-year sentence on fraud charges in March, and was promptly transferred to ICE custody.

He spent the last month in the Clinton County Correctional Facility in McElhattan, Pennsylvania, a center notorious for violence and poor living conditions.

“It’s just gloomy, you’re like in a dungeon,” a fellow inmate’s mother told RadarOnline.com.

Meanwhile, his wife Teresa — whom RadarOnline.com caught holding hands with a 26-year-old boy toy on a Miami getaway in February — recently admitted she will leave her husband if he’s deported.

A source previously told RadarOnline.com she will file divorce papers as soon as he’s kicked out of the country, which appears to be imminent.
