No Joke! Jim Bellino Slams Tamra Judge's Excuse For Calling Him 'Shady Motherf****r'

Jim Bellino said he did not take Tamra Judge's allegations that he is "going to jail" as a joke in his ongoing lawsuit against The Real Housewives of Orange County star, claiming that she acted maliciously when she made that statement on a podcast show, according to documents obtained exclusively by

In court documents filed on Oct. 11, Bellino's attorneys said Judge was not stating "mere opinion or a joke or 'irreverent social commentary,' but a simple, straightforward and provably false assertion of fact that is actionable as defamation."

Bellino's attorneys said Judge's own argument fails on its merits because she asserted Bellino has engaged in criminal activity.

"If Ms. Judge believes it is 'true' that Mr. Bellino is 'shady', then logic dictates that the statement can not only be proven to be true, as Ms. Judge contends, but also be proven to be false," wrote Geoffrey A. Neri in the affidavit. "Either way, it must be a factual assertion. Thus, Ms. Judge's own briefing undermines her own position on this motion and dispels any notion that she was merely expressing an 'opinion,' rather than a fact, when she stated that Mr.Bellino is a 'shady mothaf****r.'"

Bellino sued Judge and fellow RHOC cast member Shannon Beador after they appeared on Heather McDonald's June 26 podcast. Beador reportedly said people were paralyzed at one of Bellini's trampoline parks.

Judge and Beador fired back and said they had a right to say their opinions about Bellino because he was a public figure who had appeared on the Bravo show with his former wife, Alexis. The women have filed their own motion challenging Bellino's complaint.

In the Oct. 11 affidavit, Neri said it's is critical for his client to obtain various text messages and other communications between the women and McDonald prior to their appearance on the podcast. Bellino is asking a judge to order Judge and Beador to produce those messages as part of evidence.
