Custody Battle Explodes: Jenelle Evans Ordered Back To Court!
Dec. 2 2016, Updated 9:42 p.m. ET
Jenelle Evans is heading back to court demanding full custody of her toddler son Kaiser, RadarOnline.com has exclusively learned.
The Teen Mom 2 star and baby daddy Nathan Griffith currently split custody of the two-year-old, but she filed a Motion to Modify Custody with the court, asking a judge to give her "sole physical custody" of the child.
Evans told the court that she believes Griffith is unfit to take care of Kaiser, in bombshell court documents obtained by RadarOnline.com.
"Defendant communicated to plaintiff that defendant's mental health is not stable and that he is unable to care for the minor child," Evans' attorney wrote.

"Defendant communicated to plaintiff that he has plans to move out of the country in the near future," the documents state, claiming, "Defendant has multiple pending criminal charges."
While Evans was accused of doing drugs while pregnant with Kaiser during the Teen Mom 2 reunion taping, she claims in her court papers obtained by RadarOnline.com that Griffith is the one abusing substances.
"Plaintiff is informed and believes that defendant has a substance-abuse issue and is unable to care for the minor child during defendant's visitation," the documents state.
Griffith's attorney did not respond to RadarOnline.com's request for comment.
Expecting her third child with David Eason, Evans told the court that Kaiser's baby daddy "does not have a suitable and healthy home environment to exercise visitation with the minor child."

The MTV star also claimed that Griffith doesn't see Kaiser often, despite their court mediated custody agreement: "Defendant does not regularly exercise his visitation with the minor child," the documents state.
According to the documents, Griffith was served with the papers. Evans and Griffith have a court mediation date on January 4, 2017.
