Mel B's 12-year-old old daughter Phoenix has filed a battery police report against her father, Jimmy Gulzar, RadarOnline.com is exclusively reporting.
The former Spice Girl -- who was married to Gulzar from 1998 to 2000 -- has primary custody of Phoenix with Gulzar having visitation four times a month.
Trouble arose on October 11 when Gulzar refused to let Phoenix leave his house after his custodial time with her.
"The cops had to be called to enforce the court order, which states that Mel has primary custody of Phoenix. There was a stand off for several hours. When it became clear that Gulzar wasn't going to turn Phoenix over, LAPD responded and told Jimmy he had to allow his daughter to leave his apartment," a source close to the situation tells RadarOnline.com.
"When Phoenix came out, she was extremely distraught and very upset. The police immediately took her to the police station to fill out a report."
The police report states: "Victim is suspect's daughter. Susp has visitation rights w/daughter. When daughter attempted to leave susp's house to return to mother's home, susp grabbed vict's arm refusing to let her leave."
Mel B – whose full name is Melanie Brown -- is currently with her husband, Stephen Belafonte, and her three children shooting Australian X Factor.
As RadarOnline.com previously reported, Mel and Stephen are the proud parents of a newborn girl, Madison Brown Belafonte. Mel also has a four-year-old daughter, Angel, with Eddie Murphy.
