Real Housewives of Orange County star Tamra Barney's estranged husband filed for bankruptcy last year, and RadarOnline.com has exclusively obtained the court documents.
EXCLUSIVE DOCUMENTS: Tamra Barney's Ex-Hubby Files For Bankruptcy
According to papers filed in December last year with the Southern District of California, Simon Barney voluntarily petitioned for Chapter 13 citing the nature of his debts as "primarily consumer debts incurred by an individual primarily for a personal, family, or household purpose."
Simon stated he has between 1-49 creditors, with assets and liabilities between $50,001 to $100,000.
The bulk of Simon's debt appears to be in the form of credit cards, with a claim stemming from Chase Bank to the tune of $20,640.00.
Chapter 13 allows individuals to undergo a financial reorganization supervised by a federal bankruptcy court.
However, RadarOnline.com has learned, the United States Bankruptcy Court issued a "notice of dismissal" against Barney on January 10, 2011, because he failed to file schedules, statements and/or plan for the bankruptcy.
"The case is dismissed, the automatic stay is vacated and all pending motions and adversary proceedings are moot and dismissed," the court's response state.
As RadarOnline.com first revealed, Simon was arrested last September on a domestic violence charge after an argument ensued between him and Tamra over the custody of their dog.
"He was angry and threw the leash at her and hit her with it," a source with knowledge of the case told RadarOnline.com exclusively.
"Their kids were in the house and started crying. It was a bad scene."
Shortly after Simon's arrest, Tamra was granted a restraining order against him, keeping his at least 100 feet from her and limiting the time he spends with their three children.
The couple is in the midst of divorcing.
