A federal court judge has set a hearing for next month where Erika Jayne's lawyer will have to argue why his client should not be forced to turn over a pair of $1.4 million earrings.
According to court documents obtained by Radar, the judge presiding over the Chapter 7 for Jayne's estranged husband Tom Girardi's law firm wants all parties in court on February 15.
The hearing being set comes after the trustee presiding over the case demanded Jayne hand over the jewelry.
As we previously reported, Girardi was forced into bankruptcy last year and his firm owes a reported $101 million to various creditors. Many of his clients claim the once-respected lawyer screwed them out of millions.
Everyone from orphans, widows to fire burn victims claim to be owed money. The court recently allowed some of them to start going after Jayne for the missing money.
The trustee was put in place to take control of Girardi’s finances and figure out the best plan to pay back everyone.
As part of their investigation, they discovered bank accounts and were able to obtain the financial statements. The records they reviewed showed Girardi used money in his client’s trust account to purchase Jayne a pair of $750k diamond earrings that are now worth $1.4 million.
The motion lays out how Girardi allegedly covered his tracks with sneaky accounting.
The trustee says Girardi purchased the earrings for Jayne after a separate pair had been stolen from their home in 2007. The property had been broken into by burglars while they were aware on a 3-day vacation. The home was completely ransacked but most of Jayne’s jewelry was stored in a massive safe.
However, she left a pair of diamond earrings in a little cup in her dressing room that were worth $800k and weren’t insured. Girardi immediately replaced the item with the $750k pair.
The trustee says despite numerous demands for Jayne to hand over the earrings she has refused. He even had a conversation with Jayne’s lawyer Evan Borges about the situation.
“Mr. Borges represented that the Diamond Earrings, together with all other jewelry, is in the possession of Erika and that they will remain in her possession at a minimum until the issues involving the items have been resolved. I subsequently wrote Mr. Borges again demanding that the Diamond Earrings be turned over to the Trustee.”
The trustee says the earrings still have yet to be produced. He is demanding the court step in and order Jayne.
