No criminal charges will be filed against Britney Spears’ father, Jamie Spears, for the claims of child abuse alleged by the pop star's baby daddy Kevin Federline, RadarOnline.com confirmed.
Ventura County District Attorney Gregory D. Totten announced today that “criminal charges will not be filed against James Spears, of Westlake Village,” the office said in a statement to RadarOnline.com.
“The Ventura County Sheriff’s Office investigated allegations involving child abuse by Mr. Spears,” the statement noted about the superstar singer’s father.
“After reviewing the evidence, there is insufficient proof that a criminal offense was committed by Mr. Spears.”
Britney’s ex-husband, Kevin, 41, filed a police report against Jamieon Aug. 25 after an alleged incident at Jamie’s home.
RadarOnline.com previously reported that Kevin accused Jamie of abusing his 13-year-old son, Sean Preston.
“Mr. Federline alleged the grandfather battered one of the son’s on Aug.24, I believe the 13-year old,” Sgt. Bugarin previously told RadarOnline.com.
Britney, 37, allegedly removed the children immediately from Jamie and brought them back home, where they later stayed overnight at Kevin’s.
However, according to documents obtained by US Weekly, Kevin filed a restraining order as his attorney, Mark Vincent-Kaplan, demanded the kids be protected from Jamie.
The two went to court on August 27 for an emergency hearing to seek a restraining order against Jamie. The order was granted with no opposition from Jamie and prohibits the grandfather from coming near Preston and his brother, Jayden James, 12, for three years, another source told the outlet.

“Britney had the boys at Jamie’s condo on the evening of August 24. Jamie and Sean Preston got into an argument. Sean Preston felt unsafe and locked himself into a room. Jamie broke into the room and shook Sean Preston,” an insider claimed to the site.
“Jamie has a temper, which is no secret to anyone in the family,” another informant alleged to Us. “Fortunately, Britney did the right thing and took her boys to safety and away from her father. The whole incident was very upsetting to her and her boys. Kevin was and still is furious.”
“Preston was not physically injured but very scared and shaken up,” the source added.
As the alleged incident unfolded, Britney and Kevin established a new custody schedule for their two sons. A source confirmed to RadarOnline.com that Federline would have the boys 70 percent of the time while Britney had them for the remaining 30 percent.
