Katy's Nightmare: Perry Fights To Keep Deposition In Kesha Sex Assault Case Sealed

What is Katy Perry hiding?

The superstar and her attorneys filed a petition on Monday, August 20, 2018 seeking an emergency order to keep her testimony sealed concerning fellow singer Kesha’s sexual assault case against music producer Dr. Luke, RadarOnline.com can confirm.

In court documents obtained by RadarOnline.com, Hal S. Shaftel said Perry, whose real name is Katheryn Hudson, was only notified Friday afternoon that her testimony could be disclosed publicly.

Perry was subpoenaed on March 30, 2017 to appear and provide testimony regarding Kesha's case against her former producer.

“Ms.Hudson cooperated in providing a deposition in this action based on the confidentiality protections set forth in the Protective Order and her reasonable expectations regarding confidentiality and privacy,” Shaftel wrote in the affidavit.

“On July 21, 2017, Ms. Hudson appeared and testified at a deposition. The transcript was designated as ‘Confidential Pursuant to Protective Order,' without dispute from the parties. … On Friday, Aug. 17, 2018, at 1:01 p.m. PDT, my colleague, Vincent Chieffo, received and email from counsel for Plaintiffs Lukasz Gottwald p/k/a Dr.Kuke, Kasz Money, Inc., and Prescription Songs, LLC (collectively Plaintiffs), stating that on Tuesday, August 21, the Court will be unsealing a number of exhibits that were filed in connection with recent motions in the Gottwald v. Serbert acton, and that Ms.Hudson’s deposition transcripts is one of the exhibits that will be unsealed.”

Shaftel added he spoke to Dr. Luke’s attorneys over the weekend, and they confirmed the transcripts were sealed so they did not have to provide Perry any notice.

“At the very least, the parties should narrow the relevant excerpts of Ms. Hudson’s testimony and Ms.Hudson then should be afforded a meaningful opportunity to evaluate the details of that testimony in relation to possible public disclosure,” Shaftel wrote in the affidavit.

The Blast was first to report Perry's emergency motion.

The 33-year-old singer worked with Dr. Luke for years on many of her hit songs, including "I Kissed A Girl" and "Teenage Dream."

According to previously filed court documents, Kesha accused Dr. Luke of raping Perry in a text to Lady Gaga in 2016. Both Perry and Dr. Luke have denied the allegation.

Kesha, 31, has been locked in a legal battle with Dr. Luke for four years — she accused him of raping her over the course of her career in her 2014 complaint.
