Messiest Custody Battle Ever! 'Rehab Addict' Nicole Slams Psych Evaluation Request

Nicole Curtis is spending more time with her baby daddy, but her custody battle is far from over!
The Rehab Addict star filed her answer to Shane Maguire's request for a mandatory psychological evaluation — and claimed that they vacationed together in California just one day prior to his filing!
"Plaintiff exercised additional parenting time with the minor child on November 4, November 5, and November 6, in California," the bombshell court documents obtained by RadarOnline.com read. "In fact, the parties spent significant time together in California during this period, and not once while the parties were together in California did Plaintiff raise any issues relative to the period of October 25 to October 29/30, nor did he raise any of the other issues raised in Plaintiff's motion. Plaintiff completely neglected to mention same in his motion."
RadarOnline.com previously reported that Maguire claimed Curtis denied him time with their 1-year-old son Harper over the Halloween weekend, as she started a fight over a miscommunication. But, now Curtis is firing back that he refused to take Harper because he was mad at her.
Curtis, 40, also alleged that he violated a court order by not informing her of Harper's emergency room visit while in his care, and he returned him to her at 4:45 p.m. instead of noon.
She also claimed that since the court previously denied his request for a psychological evaluation, she should not have to take one, and that he could post photos of Harper on social media. Finally, Curtis affirmed that her book, Better Than New and her PEOPLE magazine spread do not count as social media photos.
The reality star asked the court to deny his motion, and to order him to pay her attorney's fees in the matter.

The on-again-off-again couple is due back in court later this week.
