The battle over Madonna and Guy Ritchie's son is far from over! RadarOnline.com exclusively learned that Madonna and Ritchie have been ordered to come up with their own custody agreement.

Madonna and Ritchie called in for the New York City court hearing on March 2 to fight for custody of their 15-year-old son, Rocco, who refused to return to the United States to live with his mother after the holidays.

"I am optimistic that there will be a resolution," the judge said.

Ritchie's lawyers argued it is in Rocco's best interest to be out of the spotlight by remaining in London.

"I'm still hopeful that we can come to some sort of agreement that will shield him," said one of Ritchie's lawyers. "Rocco is of an age where he can't be forced on a plane to come back."

But Madonna's lawyers fought back, claiming Ritchie is setting a bad example by the way he has handled the custody situation.

"The proper procedure was to come to New York and get the circumstances changed," Madonna's legal team said. "He taught his son that court proceedings are not important."

The teen reportedly chose to live with his father in London because of his mother's strict rules.

The next court date is scheduled for June 1st.
