An insider told RadarOnline.com that the DUI from late last month is still under investigation and there will be no court proceedings on Thursday in Van Nuys.

Under California law, when someone is arrested for a DUI, their drivers license is immediately revoked, and offenders are given a temporary provisional license, pending the outcome of a hearing conducted by the Department of Motor Vehicles.

This is separate from the criminal investigation.

On September 28, at 4:10 a.m., Bynes was arrested by the California HIghway Patrol after it was determined she was under the influence of a controlled substance.

Bynes' criminal defense attorney, Richard Hutton, won her DMV hearing, giving the troubled starlet back her driving privileges.

However, it's unlikely, Bynes will be getting behind the wheel anytime soon, because she is confined to a mental health facility after suffering another very public breakdown.
