Blame Game: Walmart Claims Tracy Morgan Not Wearing Seat Belt During Devastating Car Accident

Nearly three months after comedian Tracy Morgan filed suit against Wal-Mart — over claims their negligence led to his devastating car accident in June — the powerhouse retailer is coming back swinging. Now, RadarOnline.com has learned, Wal-Mart attorneys have claimed Morgan is to blame for his injuries — because he wasn’t wearing a seatbelt.
On Monday, attorneys for the retail giant delivered documents to a New Jersey federal court that claimed the beloved 30 Rock star's injuries “were caused, in whole or in part, by his failure to properly wear an appropriate available seatbelt restraint device.”
Morgan, 45, is just one of several people who are suing Walmart for negligence, alleging that Walmart truck driver Kevin Roper was too tired to be behind the wheel.
As RadarOnline.com previously reported, officials said Walmart truck driver Roper hadn’t slept in a full day prior to the crash.
In June, Roper pleaded not guilty to vehicular homicide and assault by auto during an arraignment.
Morgan was being driven in a limo bus on June 7 when it was struck from behind by the Walmart vehicle.
As RadarOnline.com has reported, Morgan suffered a broken leg and femur, broken nose, and several broken ribs.
The crash also killed Morgan's fellow comedian pal James McNair, 52.
In its filed answer, Walmart says, “By failing to exercise ordinary care in making use of available seatbelts, upon information and belief, plaintiffs acted unreasonably and in disregard of plaintiffs' own best interests.”
