On the very day that TLC filed a breach of contract lawsuit against Jon Gosselin, his estranged wife Kate was spotted checking out of a hotel and heading back over to her Wernersville, PA estate for a week with her kids.

Jon and Kate alternate weeks with their eight children, who stay put at the house.  Kate has made the nearby Homewood Suites her home-away-from-home during her "off" weeks.

TLC is suing Jon for interfering with the production of the newly renamed Kate Plus 8, and for taking cash for other TV appearances when he is under an exclusive contract to the cable net.

Jon's problems don't end there.  A former nanny, Stephanie Santoro, told RadarOnline.com exclusively that Jon smoked pot in front of the kids!

The last episode of Jon & Kate Plus 8 was broadcast October 14 and drew 2.5 million viewers.

Although Kate remains in the TLC family - the cable net is also developing a new series for her - the future of any project involving the children is in doubt.
