Josh Waring has been hit with a lawsuit in regards to a June 2016 shooting, RadarOnline.com has learned.

Daniel Lopez is seeking compensatory damages for wage loss, hospital and medical expenses, general damage and loss of earning capacity after Waring, 27, allegedly shot him in the torso.

Lopez also named the sober living facility where Waring was staying in the suit.

"The residence allegedly operates as a sober living facility, and has been doing so for at least one year," he claimed in his report. "It operates as such without proper licensing, credentials or permits."

"On June 19, 2016, there were approximately 16 people within the residence, in violation of the rules of the home," he alleged. "At approximately 5 or 6 p.m., Joshua Waring came to the home to drop of sic a cell phone to one of the people residing in the home. Joshua Waring left the residence."

"At approximately 2:30 a.m. on June 20, 2016, Joshua Waring returned in his vehicle and began making noise outside the home by honking his horn," he added. "In violation of the rules members of the home went outside and told Waring to leave. Waring then sped off in his vehicle, made a U-turn, came back in front of the residence and began shooting, striking an sic injuring Daniel Lopez."

"The defendant(s) and each of them were aware of issues Mr. Waring had at the residence while he had resided there," he slammed. "The failure to follow rules, procedures and basic common sense allowed all of the residents to be put in harms way when Waring first came to the home, and when he later returned."

"The residence negligently operates in a fashion such that it is improperly and negligently maintained," he described. "The residence has been the subject of multiple complaints by the neighbors resulting in numerous visits from the police, there have been incidents of violence, public disturbances and drug use in public."

RadarOnline.com previously reported that Waring was charged with three counts of attempted murder, three counts of personal use of a firearm, and one count of inflicting great bodily injury. He pleaded not guilty to all three.

He was later charged with battery, hit and run with property damage, evading police/reckless driving, resisting arrest and obstructing an officer, and unlawful taking of a vehicle.

Waring told RadarOnline.com exclusively that he was innocent in the case, although he "was using" heroin and Xanax at the time.
