Adnan Syed is seeking to be released on bail as he awaits a retrial, RadarOnline.com has learned.

Back in February, the 35-year-old's lawyers argued that Syed deserved a new trial after his original attorney, Cristina Gutierrez, failed to contact key alibi witnesses and didn't fight to dismiss other evidence surrounding the case had not been reliable.

As RadarOnline.com readers know, Syed's case became wildly popular after the podcast, Serial, made its debut in 2014, detailing the killing of his former girlfriend, Hae Min Lee.

Many fans of the series assisted in uncovering new evidence and questions regarding the case, ultimately leading to a Baltimore judge's decision for a retrial.

Now, Syed has filed new court papers, arguing that he is not a flight risk nor a danger to the community while he awaits retrial.

The documents cite that Syed has had no history of violence before the murder case, and has been a model prisoner.

"I want him out," Syed's lead attorney, Justin Brown, told PEOPLE. "I think he's been in there too long, he shouldn't have been in there in the first place, we're going to do everything we can to get him back."

Raquel Coombs, ‎Director of Communications at the Maryland Office of the Attorney General, released a statement saying, "We have not received the filing. Once we do, we will review and determine how best to respond."
