During a court hearing in Los Angeles on September 4, a lawyer for the 43-year-old Spice Girls singer, also known as Melanie Brown, claimed that the mom of three planned a birthday party for Madison on Thursday of this week, and demanded she get custody of the little girl during this time.
"Your honor, she did not even call her on her birthday!" Belafonte's attorney Grace Jamra interrupted the courtroom via conference call.
Madison turned 7 over the weekend on September 1, when Belafonte, 43, had custody.
Despite the outburst, the judge ruled that Madison could be with her mother to celebrate at the September 6 birthday bash.
The judge also ordered Mel B to undergo random drug and alcohol testing for the next four months with a federally-approved facility.
As RadarOnline.com previously reported, she agreed to submit to the testing in an explosive court hearing on Friday, August 31.
RadarOnline.com first reported that Belafonte demanded full custody of their daughter, claiming her admitted alcohol abuse makes her an unfit parent.
In court today, both sides were forbidden from drinking alcohol during their custody period.
Now, the exes must choose a child custody evaluator to reevaluate the custody agreement by September 14.
