Judge Steven T. O'Neill upheld the state experts' conclusion that the convicted comic, 81, is a "sexually violent predator" early Monday morning, RadarOnline.com can exclusively report.

The two-day sentencing hearing started with arguments regarding the convicted comic's "predator" label.

"The purpose of this law is not to shame defendants," the prosecutor stated in court. "They're in place to shield the community from danger – it's for protection of the public," noting it's an important factor in keeping "children" safe from dangerous predators.

The defense countered the claim, noting the label was deemed "unconstitutional" by the Pennsylvania Superior Court in recent decisions. "They can't constitutionally be applied to Mr. Cosby."

Given his "sexually violent predator" label, Cosby has to report to the Pennsylvania State Police four times per year and alert them of his every move when he isn't behind bars.

RadarOnline.com broke the story: Cosby was deemed a "sexually violent predator" after lashing out on state shrinks at his Pennsylvania posh prison palace.

A source inside the felon's inner circle revealed exclusively to RadarOnline.com that the convicted comic had a bizarre "going away party" late last night in his home where he and his wife got into a heated argument, resulting in her ditching the first day of his two-day sentencing.
