Bethenny Frankel Looks Solemn In Court As Judge Shuts Down Ex’s Demand For Drug Test

Though she landed a victory in her ongoing custody battle with ex-husband Jason Hoppy, Bethenny Frankel looked solemn as she left court on Monday morning in RadarOnline.com’s exclusive photo.
Donning a long black coat and sunglasses aside her high-power attorney Allan Mayefsky, The Real Housewives of New York star, 47, "appeared happy, sure, but upset she had to be there in the first place," an onlooker told RadarOnline.com.
As RadarOnline.com exclusively reported, Frankel faced her ex Hoppy, 48, on October 15 as a judge decided she should not have to submit to drug and alcohol testing in their bitter fight over daughter Bryn, 8.
"She is allowed to occasionally go and drink without her daughter present," Judge Michael Katz said. "What exactly is your claim? That she goes out and occasionally has a drink, because that’s not illegal."
"It is my job to see if there is a reasonable doubt, and so far I don’t see it."
"I think you are trying to exploit Ms. Frankel to embarrass her. The appeal is denied."
Before the ruling, Hoppy’s attorney claimed the reality star’s drunken behavior on the Bravo show and her ex-boyfriend Dennis Shields’ apparent overdose death in August should require her to submit to substance use testing.
Frankel’s lawyer countered that her TV drinking is simply "entertaining," and that the star had no knowledge of Shields’ drug problem.
The onlooker told RadarOnline.com that Frankel let out a sneer as her former husband passed her in the hallway outside the courtroom.
