Kids In Danger? Jenelle Evans Breaks Law By Not Putting Fence Around In-Ground Pool

Jenelle Evans continues to break the law, but this time it could be putting her children in danger. RadarOnline.com can exclusively reveal the Teen Mom 2 star is apparently breaking North Carolina law by not having a fence around her in-ground pool.

Evans, 26, has posted various photos of her in-ground pool since she moved into the home in 2017. In all photos, there appears to be no fence or barrier surrounding the pool.

"Ya'll need a fence around the pool before a child drowns," one commenter wrote on Instagram, as a second said, "I'm pretty sure where she lives too it's by law that you have to have a fence around your pool."

A spokesperson for the North Carolina Building Codes department confirmed to RadarOnline.com that it is the law to have a barrier around an in-ground pool.

"An outdoor swimming pool, including an in-ground, above-ground or on-ground pool, hot tub or spa, shall be surrounded by a barrier which shall comply with the following: 1. The top of the barrier shall be at least 48 inches above grade measured on the side of the barrier, which faces away from the swimming pool," the North Carolina State Building Codes Amendments, which were effective on January 1, 2018, read, "The maximum vertical clearance between grade and the bottom of the barrier shall be 2 inches or 4 inches where concrete or fixed solid material is used measured on the side of the barrier which faces away from the swimming pool. Where the top of the pool structure is above grade, such as an above-ground pool, the barrier may be at ground level, such as the pool structure, or mounted on top of the pool structure. Where the barrier is mounted on top of the pool structure, the maximum vertical clearance between the top of the pool structure and the bottom of the barrier shall be 4 inches."

In September 2017, a fan asked Evans if she is going to put a fence around the pool. "Of course, a pull lock like at public pools," she tweeted. "To get your permit approved for your pool you have to get a fence, also to protect wildlife."

Evans is mother to sons Jace, 8, Kaiser, 4, and daughter Ensley, 1, who she shares with husband David Eason. Eason is father to young children Maryssa and Kaden from previous relationships.

The drama comes one month after Olympic skier Bode Miller and wife Morgan's 19-month old daughter Emeline was found unresponsive in a neighbor's pool. She passed away after being rushed to the hospital.

This isn't the first time Evans has been accused of endangering her children. She revealed on a recent episode that CPS has been called on her 20 times. The grandmother of her son Kaiser, Doris Davidson, filed an emergency custody order in September 2017 when she accused her of testing positive for marijuana while pregnant with her daughter Ensley. Earlier this month, baby daddy Nathan Griffith and his mom refused to hand Kaiser back after a visit when they claimed to have noticed bruises on his butt. They accused her husband Eason of child abuse.
