A child abuse allegation against Britney Spears' father, Jamie, has been submitted to prosecutors, who are now reviewing the shocking claims, RadarOnline.com can exclusively reveal.

"Prosecutors are now reviewing the allegations against Jamie Spears to see whether or not criminal charges should be filed," Sgt. Marta Bugarin confirmed with RadarOnline.com exclusively.

"The Ventura County Sheriff’s filed the allegation as misdemeanor battery on a child."

As RadarOnline.com readers know, the singer's famous father was accused of child abuse against her 13-year-old son, Sean Preston.

The singer's ex-husband and father of her two children, Kevin Federline, filed a police report on August 25 at the Ventura County Sheriff’s Department, alleging battery on his minor son, Sgt. Bugarin, spokeswoman for the Ventura County Sheriff’s Office, revealed to RadarOnline.com on Tuesday.

Sources claimed Kevin accused Jamie of abusing the teen after an incident that allegedly occurred at the grandfather's home in Thousand Oaks the day before.

“Mr. Federline alleged the grandfather battered one of the son’s on Aug. 24,” Sgt. Bugarin said.

Britney allegedly removed the children from Jamie, and they later stayed overnight at Kevin's home.

As of right now, Jamie, 67, has not been arrested, Bugarin said.

A judge granted a temporary restraining order that forbids Jamie from having contact with Britney’s sons for three years.

The conditions of the order also state that an adult Kevin, 41, approves of must be present whenever the boys are with Britney, according to the source, and it can’t be Jamie.

Another source revealed more details about the incident to Us Weekly

“Britney had the boys at Jamie’s condo on the evening of August 24. Jamie and Sean Preston got into an argument. Sean Preston felt unsafe and locked himself into a room. Jamie broke into the room and shook Sean Preston,” an insider told Us.

“Jamie has a temper, which is no secret to anyone in the family,” another informant told the site. “Fortunately, Britney did the right thing and took her boys to safety and away from her father. The whole incident was very upsetting to her and her boys. Kevin was and still is furious.”

“Preston was not physically injured but very scared and shaken up,” the source added.

Meanwhile, sources tell RadarOnline.com exclusively Britney is "very upset" with her dad and wants out of the conservatorship run by her father for more than a decade.

The pop singer was horrified by her father’s actions, a source revealed to RadarOnline.com.

“She’s very upset with her father, and probably won’t ever speak to him again,” the insider said about Britney, 37.

The source said Britney is planning to use the alleged incident with Jamie to make a huge change in her life.

“She is going to try and use this to get out of the conservatorship, and stop having Jamie be her conservator,” the source told RadarOnline.com. “She doesn’t want him running her life anymore.”
