“Therefore, I am requesting to invoke my 5th Amendment Rights,” the November 26 filing continued. "If your honor orders me to participate in a deposition or other discovery, I respectfully request that this court appoint counsel to protect my 5th Amendment Rights on a question by question basis.”

On the same day, Nassar’s attorney Jaqueline McCann also wrote a letter to the judge.

“His state criminal convictions are yet final as his direct appeal remains pending,” she wrote. “And thus he retains his Fifth Amendment Privilege against self-incrimination even in regard to the Ingham and Eaton county cases.”

If the judge orders Nassar to participate in the deposition, then she asks he be appointed a public defender, as her office cannot represent him in the civil action.
