EXCLUSIVE: Lawsuit Involving Jesse James Can't Go To Trial Because Of Rehab

A lawsuit against Jesse James will not be able to proceed to trial for the time being because he is in rehab, RadarOnline.com has exclusively learned.

James is being sued by Fortune Fashions Industry because the company alleges he backed out of a deal to work with the company on a line of clothing for Wal-Mart. 

Fortune Fashions Industry claims that James worked directly with Wal-Mart and that James stole one of Fortune Fashions Industry's executives to work on the clothing line.

The case was scheduled to go to trial this spring, but in sworn declarations submitted by James' attorneys, the docs state that the trial can't proceed at this time because James is currently in rehab in Arizona.

James has also filed a counter suit against Fortune Fusion. A trial date of May 4, 2010 had been set.

James' attorney Kim D. Ashley states, "Mr. James is currently unavailable as he is in a treatment facility. Mr. James is expected to be unavailable from 30-60 days.

One of James' associates, Hildie Katibah says in a sworn declaration, "Jesse James is in a treatment facility participating in a program that requires a minimum  of 31 days of participation in order for it to be effective.

He is therefore expected to be unavailable for the next 30 to 60 days. I cannot go into any further detail at this time." Katibah's declaration is dated March 29th, 2010.
