Liza Marquez, the mother of David Caruso's two young children, has filed legal papers to have the settlement she reached with the CSI Miami star, David Caruso thrown out, because of shoddy legal advice she claims she got from her former attorney.

Marquez also claims Caruso isn't making settlement payments to her. In court docs, she states, "In January 2009, Defendant was required to make the first payment of approximately $335,000, but failed to do so. He also failed to make his second payment of approximately $335,000 due and owing in January 2010, as we agreed. The third payment $335,000 will be due and owing in January 2011.”

David Caruso Sued By Mother Of His Children

Marquez claims she got bad legal advice and was forced into signing the settlement agreement under pressure from Opri, and that she only had approximately "20 minutes" to decide. Marquez is now representing herself, and the hearing is set for May 4, 2010.
