EXCLUSIVE: David Caruso's Legal Battle With Ex Gets Nastier

The long-running legal battle between David Caruso and his former girlfriend Liza Marquez just got nastier.

According to Maquez’ attorney Debra Opri (you might remember that name from Larry Birkhead – Anna Nicole Smith days, Caruso was supposed to show for a deposition on May 15 but the “CSI: Miami” star but he failed to appear.

Caruso and Marquez, who never married, have two children together and broke up two days after the second child was born in 2007.

That’s when Caruso demanded a paternity test be taken.

That matter is still in litigation.

Marquez latter followed up with her own action against the actor, claiming he was not following through on his promises to support her and their kids.

It was on that matter that the May 15 depo was scheduled. According to the court documents, he was supposed to bring with him everything from evidence of his income and retirement plans to a breakdown of what he spends on everything from his mortgage to dental care and his Auto Club membership.

A spokeswoman for Caruso’s attorney, Beverly Hill “super lawyer” Stephen Kolodny told RadarOnline.com they were not going to comment “out of respect for the children’s privacy.”

Opri wants the court to order sanctions against Caruso in the amount $4,326.55.  The court will rule on June 16.
