Alarcon claims in the lawsuit that, "On September 22, 2006, Wahler committed acts of violence, threats of violence, and made racial epitaphs towards the plaintiff intentionally interfering with the plaintiff's constitutional right to work as a tow truck driver which is guaranteed under the Constitution."

Alarcon claims that since his civil rights were violated by Wahler, he is also entitled to an additional 25k. He is also seeking attorney's fees as well.

Wahler pleaded no contest to a battery charge and was ordered to rehab and 36 hours of anger management.
