RadarOnline.com reporters saw her earlier this year at the Los Angeles club Bardot smoking a joint at her table in the smoking section. She was
stumbling across the club and appeared bloated.

In January of this year she was at the Troubadour club in Los Angeles to see the group the Cold War Kids. “She’s obsessed with the band,” said a source who saw her there. The source said Mischa was again smoking dope and was romantically pursuing the group’s lead singer.

She was spotted at Chateau Marmont with the Cold War Kids in February and eyewitnesses told RadarOnline.com, “She tried to hook up with the lead singer but was turned down and ended up coming on  to the drummer. She was a mess. Totally out of it.”

Months before, at the end of 2008, multiple sources told RadarOnline.com they saw Mischa partying in LA several nights a week. On Dec. 27, 2007, she was pulled over and arrested for DUI and marijuana possession, and later released on $10,000 bail.

The followng year in April, Barton struck a deal with prosecutors and received 3 years of unsurpervised probation, had to pay a $2,000 fine and attend alcohol education classes.

In an interview with Marie Claire UK, Barton said she chose to go to rehab at the time because, “I wanted to prove to the court that I would
take it completely seriously. I went to rehab to prove I was sober.”
