Kate's Nightmare! Chastain To Face Trial In Domestic Violence Case

Kate Chastain's case against her ex-girlfriend will go to trial, RadarOnline.com has learned.
RadarOnline.com has obtained the bombshell court documents filed after her October 13 court date, and can reveal that a docket sounding has been scheduled for early November.
Chastain, 33, waived her right to a speedy trail against the state of Florida on September 13, 2016.
The Below Deck star was arrested on June 13, 2016 after her then-girlfriend, Rocio Hernandez, filed a complaint against her. Chastain was charged with battery by strangulation, domestic violence by the Melbourne Beach police department.
Hernandez accused Chastain of attacking her during an altercation in their shared home on June 11, according to the explosive documents.
She stated that she came home after work around 1:30 in the morning, and the reality star came home in a fury shortly after.
"Ms. Chastain arrived home from a bar and was intoxicated," the report read. "Ms. Chastain then started to verbally abuse Ms. Hernandez to get her to fight. Ms. Chastain went into a fit of rage and physically attacked Ms. Hernandez and tried to steal her phone."
"She was bitten on the forearm, inner bicep and leg," the report continued. "She was also held down and choked, 'strangled.' Ms. Hernandez also advised that she felt her airway close during the incident."
Hernandez claimed she then tried to go into the living room to sleep on the couch, but Chastain wouldn't let her go.
"Ms. Chastain followed her and started to verbally abuse her," the report detailed. "Ms. Chastain told Ms. Hernandez to remove all of her stud and get out of our home…Ms. Chastain said that she would also change the locks to the residence."
Hernandez told police "this would be the third time she had been "thrown out in the last month."
Hernandez refused to engage, so the Bravolebrity "sat on top of her and lit a cigarette and continued to verbally abuse her. Ms. Chastain then put her knee on her head and pulled her hair. She also covered her mouth and pinched her nose so that she couldn't breath sic."
"Ms. Hernandez advised that this isn't the first time that events like this took place," the report concluded. "She was afraid to come forward due to Ms. Chastain saying that she knows everyone in the town and nothing will be done."
Chastain detailed the aftermath of her arrest in a lengthy blog post focused on adopting a dog to help with the pain.
Hernandez and Chastain recently appeared together on an episode of Below Deck, as it was filmed prior the incident.
