No Fight: Fraudster Joe Giudice Certain To Be Deported, Declares Top Lawyer
Teresa Giudice’s husband Joe is almost certainly going to be kicked out of the country in the very near future, RadarOnline.com can exclusively report.
As RadarOnline.com first reported, Italian native Juicy Joe, 46, is officially in the process of being deported from the United States for his fraud crimes. An Immigration and Customs Enforcement spokesperson exclusively told RadarOnline.com the reality dad is in “removal proceedings,” and could even be deported before his three-year prison sentence is complete in March 2019.
Though Giudice’s attorney told People that “no decision” had been made regarding his status, New Jersey immigration lawyer Eric Mark of the Law Office of Eric M. Mark insisted to RadarOnline.com that “chances of him being deported are as close to 100 percent as you can get.”
For prisoners with an aggravated felony — such as fraud of more than $10,000, like Joe — “ICE will start the removal proceedings while the prisoner is getting close to the end of their term,” Mark explained. “And then if the case has been concluded, they can be deported directly from prison instead of being transported into immigration custody."
As RadarOnline.com reported, Joe began the proceedings within the past few months. His last hearing was held on June 20 in Pennsylvania’s Allenwood prison, where he was recently transferred to serve the remainder of his sentence
The immigration court makes no exceptions for reality stars or prisoners with young children, the attorney insisted. And the only way to avoid the deportation is to prove he could be tortured in his native country.
"An aggravated felony pretty much overcomes any sympathy to family connections," Mark explained. "It's a very unforgiving law."
"He would have to show it's more likely that if he returned to Italy he would be tortured,” Mark said. “And that is unlikely to happen if he is from Italy."
Or, Mark claimed, Joe would have to prove his United States citizen spouse, Teresa, and his children would be subject to "extreme and unusual hardships" in his absence.

"It is a limited exception and very difficult to pursue successfully," Mark said. "They look at medical, professional, familial, and financial hardships. You have to show that the wife and children would suffer those types of hardships beyond just the normal hardships of missing their father and missing their husband."
After deportation, Joe will likely be forbidden from entering the United States for 15 years or longer.
“He is going to be barred for at least 15 years. And realistically with an aggravated felony, a lot longer,” Mark told RadarOnline.com. “He would only be able to get like a visitor’s visa maybe many years into the future. He is not going to be able to get another green card.
Despite the strong chances of her husband’s deportation, Teresa is planning to party at a New Jersey club this weekend — and has put on a “happy” face around even her close friends.
“Teresa is acting like nothing happened. Regular Teresa. Happy as can be,” a friend told RadarOnline.com. “I really don’t understand how she can be so happy right now if this is really going on. She’s just really hiding it.”
