Erika Jayne knew that Thomas Girardi was allegedly embezzling money from orphans and widows, claims the attorney suing her estranged husband.
Jay Edelson alleges he has proof that the Real Housewives of Beverly Hills star's knowledge of Girardi's alleged scheme ran deep.
Edelson sued Girardi last year, alleging he and his soon-to-be ex-wife used the money that was supposed to go to Lion Air Flight 610 victims to fund their lavish lifestyle.
In a brand-new interview with Kate Casey obtained by Radar, Edelson claims Erika was "incredibly involved" in her husband's alleged scheme and believes he has evidence to back it up.
"I will go to my grave saying that Erika is smarter of the two of them," Edelson tells Casey on her podcast Reality Life With Kate Casey, adding he thinks the Bravo personality "sheet played him [Girardi] pretty well."
When asked about the potential legal ramifications for Erika, Edelson doesn't hold back.
"We believe we're going to be able to prove that Erika was incredibly involved in not just the law firm, but also, he was loaning money to her company tens of millions of dollars to her company," he alleges, "And we think that money came from client funds."
Edelson also says even if Erika claims she had nothing to do with Girardi's alleged embezzling scheme, he doesn't think a jury will buy it.
The attorney also says he plans on depositing the XXPEN$IVE singer, as well as her soon-to-be ex-husband.
Revealing Girardi's former business partners will also be deposed because they "really know where the bodies are buried," Edelson tells Kate, "We expect to be deposing Erika as well, and Tom and that's where the rubber meets the road."
"She can say whatever she wants on her reality show, but when she's under oath, we're going see a totally different Erika Jayne. And I'm, I cannot wait to take that deposition," he adds.
When it comes to the backlash surrounding Erika's remarks on RHOBH about her divorce and their lifestyle, Edelson insists her comments are "calculated, but not calculated in a smart way."
Saying it seems she's mostly concerned about maintaining her status as a reality star, Edelson believes she plays "kind of the victim."
"And she's doing that very well. She's very savvy," he states, adding that he believes being on RHOBH is "absolutely not helping" her legal issues.
