A security guard is seeking a default ruling against Kourtney Kardashian's former boyfriend Younes Bendjima.

Mario Herrera is seeking $5.35 million in damages against the French born model after he alleged he assaulted and battered him at Coachella after he refused to let him enter a restroom with Kourtney.

The security guard filed a request for a judgement on January 28, 2019, against him because he still has not responded to the complaint.

The court initially rejected Herrera's request for a judgement in October because the court needed proof that the complaint was actually served to the model.

These papers were eventually served on Jan.28, 2019 at his West Hollywood apartment.

Bendjima allegedly attacked Herrera at the Coachella music festival last year after he refused to let him enter the restroom with Kourtney.

Herrera claims that sent Younes into a rage, causing him to pick Herrera up, slam him against a wall and shout expletives.

The lawsuit claims Herrera's injuries were so bad, he had to be treated at a hospital - he's suing for assault, battery, intentional infliction of emotional distress and negligence.

Bendjima – who is no longer dating Kardashian – was also caught on surveillance video outside Delilah in West Hollywood attacking a staff member during a brawl last March.
