Teresa Giudice's worst nightmare has become a heartbreaking reality. A judge ruled in immigration court this morning that The Real Housewives of New Jersey star's jailbird husband Joe must be deported from the United States to his native Italy, RadarOnline.com can exclusively report.

"Based upon the law, I find you deportable and ineligible for any kind of relief," Judge John Ellington announced at the October 10 court hearing in Pennsylvania's York Immigration Court.

"Mr. Giudice, no matter how this turns out, I wish you the best. I decided this case as a matter of law."

The 46-year-old felon, who appeared at the hearing from his Allenwood, Penn. prison via teleconference, immediately argued with the judge over the ruling.

"I don't understand how I can be deported on this case," he stammered, clearly shocked. "If you will, I'll tell you my side. I shouldn't even be here right now."

"I have to go back and tell my kids this, and they've been waiting to hear from me."

"I get no joy in telling a family this news," Judge Ellington responded.

"My charges are one of the lowest charges in this whole BOP facility or whatever you call it. I can explain," cried Giudice, who is serving three years on fraud charges.

"I don't think your attorney will want that, Mr. Giudice," Ellington said.

The judge explained, however, that Giudice has a chance to file an appeal by November 9.

During his last court hearing on September 1, Giudice begged the judge to let him stay in the U.S. with his famous wife and their four daughters.

"I've been here my whole life, I wouldn't know what to do in any other country," he told the court via teleconference. "I want to stay here."

Though a rep for the family vehemently denied it, RadarOnline.com first reported Giudice was in deportation proceedings in June.

"ICE has lodged a detainer, and he is in removal proceedings," an ICE spokesperson told RadarOnline.com exclusively.
