Accusations are flying between Hailey Glassman and Jon Gosselin, with Hailey claiming Jon pushed her against the wall in their New York apartment and Jon claiming Hailey trashed the apartment, destroying his belongings and leaving a menacing note pinned to the wall with a knife.

EXCLUSIVE: Hailey Glassman's Attorney "She's Upset" Over Jon Gosselin Attacking Her

Both sides are denying the accusations. As RadarOnline.com previously reported Hailey's attorney, Stephanie Ovadia, claims Jon's story about the apartment being trashed is merely a "publicity stunt" and now in an exclusive interview Jon's attorney, Mark Heller, tells RadarOnline.com that Hailey is making up her claims of abuse simply as retaliation against Jon's claims.

EXCLUSIVE: Hailey's Lawyer Admits She Took TV, Denies Burglary

"Her legal people obviously advised her to put this out there," Heller tells RadarOnline.com. "Often times when you have a domestic situation and one of the parties goes down to a police precinct and makes a complaint its not uncommon that the other party is urged to make a counter claim. So the one party will have a bargaining chip, 'you withdraw your claim I will withdraw my claim'

VIDEO: Hailey Says Jon Is Emotionally Abusing Her

"When Jon called 911 on the 26th December and had police come to his apartment,  although he didn’t specifically accuse Hailey, a lot of evidence pointed  in her direction. He is leaving it up to the police to determine if she is the perpetrator and make an arrest. That is the process going on now.

"However, when Hailey was contacted by police, her legal people decide to come up with this ploy – to say he harassed her – however, it flies in the face of what makes good common sense.

"If Jon did push Hailey on December, 20th why would she wait a week to make a complaint? That’s another thing the D.A. and police will take into consideration, when someone reacts inappropriately. You contact police within minutes like Jon did. You don’t wait a week - if you want credibility you do it right away.

"This effort for a  counter claim will fall on deaf ears. This is less than plausible and not credible, a week after he calls the police she comes up with this scenario and says he did  this to me.

"I think the police investigating this matter will decide to do the right thing.

"Also, Jon Gosselin is a lover not a fighter. Although he has been accused of stealing a kiss, he has never been accused of sucker punching any of these ladies he has been involved with

"When the evidence comes out – the only suckers will be  the individual who made a false complaint against Jon.

"He clearly denies this. The motivation that he saw Hailey kissing another individual linked to Michael Lohan would not inspire him to do this because his relationship had been over for sometime and he was not jealous so that story has no credibility."
