‘She Did Not Kill Her Baby’: Defense for Teen Mom Claims Nurses Responsible for Death of Newborn Found in Hospital Trash

A New Mexico teen accused of killing her newborn and throwing the baby into a trashcan in the hospital bathroom now claims that hospital staff caused the baby’s death, RadarOnline.com has learned.

As Front Page Detectives previously reported, 19-year-old Alexee Trevizo was charged by prosecutors in Eddy County with first-degree murder in connection with the death of her infant son.

In January, Trevizo went to the Artesia General Hospital with severe back pain. She allegedly denied being pregnant and then locked herself in a bathroom, officials said. After she came out, a housekeeper found a large pool of blood in the bathroom and a trash can that was heavier than normal.

The housekeeper called in nurses, who found the dead body of a newborn boy inside a bag that was hidden underneath other items, authorities said.

Trevizo’s lawyer, Gary Mitchell, told DailyMail that his client’s name has been smeared with lies.

“The fact is, she did not kill her baby," Mitchell said. "The testing [that was done] to determine what she did is so antiquated that it is medieval."

According to prosecutors, Trevizo allegedly strangled the newborn. However, Trevizo reportedly said the baby was not breathing or crying at the time of birth and she didn’t know what to do.

“There was no strangulation," Mitchell claimed. "This is not a murder case.” He alleged that nurses gave Trevizo morphine and a “cocktail of drugs” that should never have been given to someone in labor, according to the DailyMail.

Mitchel said strangulation was not the “primary cause of death of the baby,” adding, “Guess what does cause major breathing issues in fetuses? Morphine.”

A toxicology report completed on the baby showed he had 0.19 nanograms of morphine in his system, along with COVID-19 and influenza, Mitchell said.

Prosecutors claim Trevizo knew she was pregnant and took measures to end the newborn’s life, but Mitchell stated she had no idea until she gave birth.

Mitchell also claimed medical staff gave Trevino the drugs unintentionally and continued to do so, although the baby was being harmed, the DailyMail reported.

Mitchell told the outlet, “They give her ketorolac, which you are not meant to give to pregnant women, and ondansetron for nausea. They give her Cyclobenzaprine, a muscle relaxer, acetaminophen, and morphine, which you are definitely not meant to give during labor.”

All this was allegedly administered before medical staff got the results from blood tests, which showed she was pregnant, DailyMail reported.

On March 28, the New Mexico State Office of the Medical Investigator ruled the newborn’s death a homicide, the same day police presented their evidence to the district attorney’s office.

Trevizo was charged with first-degree murder and tampering with evidence. She is being held without bond until her trial.
