Heather Locklear’s fiance was a no-show at his court hearing, but Chris Heisser's attorney exclusively told RadarOnline.com that his troubled client is remaining “tough” despite going through some “hard times.”

Heisser was scheduled to appear on Tuesday, June 19, at Ventura County Superior Court for his arraignment on a DUI charge. Heisser, 56, was stopped by California Highway Patrol officers at 12:34 a.m. on Feb. 26, just hours after he and Locklear were allegedly involved in a blowout fight at that lead to Locklear’s arrest.

During that February incident, 56-year old Locklear allegedly bit Heisser on the nose and threatened Sheriff’s deputies who responded to the 911 call to her home in Thousand Oaks, Calif.

As RadarOnline.com exclusively reported, the two were involved in another incident on Friday, June 15, where Locklear fought with Heisser outside a retail area near her Thousand Oaks home.

Two days later, Ventura County Sheriff’s deputies and fire personnel also responded to a 911 call at Locklear’s home after the actress allegedly choked her mother and threatened to kill herself. Locklear checked into a local hospital for psychiatric evaluation that Sunday, sources told RadarOnline.com.

Heisser, who has stood by Locklear’s side as the Melrose Place actress went to rehab after her February arrest, continues to face his own legal problems and could face a maximum sentence of 180 days in local jail for the DUI charge.

However, Jay Leiderman, Heisser's attorney, said since this is his first DUI arrest, the 56-year old more than likely would not have to serve that maximum sentence. Judge Michele M. Castillo agreed to continue Heisser’s arraignment to June 27 so he also could appear before the judge who initially handled the case.

"We have to wait and see,” Leiderman told RadarOnline.com after Tuesday’s hearing . "I will discuss it with Mr. Heisser and we will come to a conclusion when the time is right. The judge considers the individual facts and circumstances of each case and keeps their mind open until he has heard them. He hasn’t heard anything yet because I have not been ready to discuss this yet. I would expect that to happen next week."

Leiderman would not comment further on Heisser’s case or the alleged fights that occurred in February and the past weekend between his client and Locklear.

When asked how Heisser is doing, Leiderman said, “He’s a tough cookie, but you know, he would rather not be going through any hard times, as all of us would.”

Leiderman told Judge Castillo he would need “a couple of days to get the plea in” before asking to approach the bench. After speaking to Leiderman and the prosecutor on the case, Castillo granted Leiderman’s request to continue the case to June 27.
