Prosecutors Ask Judge To Drop Mark Salling Child Porn Indictment After Star's Suicide

The Department of Justice requested all charges be dropped against Mark Salling in his child porn case after he committed suicide, RadarOnline.com exclusive learned.

In legal documents obtained by RadarOnline.com, the U.S. Attorneys asked a U.S. District Court judge to dismiss the indictment against the late Glee star, who was found hanging in a tree on January 30.

“Pursuant to Rule 48 of the Federal Rules of Criminal Procedure, and by leave of court endorsed hereon, the United States Attorney for the Central District of California hereby moves to dismiss the above referenced case as to defendant Mark Wayne Salling, without prejudice,” the motion filed in the United States District Court Central District of California stated.

As RadarOnline.com first reported, prosecutors first needed “documentation” about Salling’s death , which they explained in a footnote in the court documents.

“While the government has not reviewed official documentation, it has been reliably informed and believed that defendant Salling is deceased.”

The DOJ spokesperson Thom Mrozek told RadarOnline.com, “The judge has not yet granted the motion.”

Salling pleaded guilty to the charges, and was scheduled to be sentenced in March. He was facing between four and seven years in prison.

His cause of death was ruled “asphyxia by hanging,” the Los Angeles County Coroner’s spokesperson Ed Winter told RadarOnline.com. He was 35.
