OC Housewife Tamra Barney Asks Judge To Overturn Ex-Husband’s Ban On Their Children Appearing On Reality Show

Real Housewives of Orange County star Tamra Barney has launched a court bid in a desperate attempt to have a judge allow her three children with ex-husband Simon appear on the hit Bravo show, RadarOnline.com has exclusively learned.
The 46-year-old Bravolebrity wants the pair’s kids — Sidney, 15, Spencer, 13, and Sophia, 8 — to appear on season nine of the reality program.
"Petitioner (Simon) is acting in bad faith,” a furious Tamra told an Orange County, Calif., court in a request for an order that would force Simon to allow the minors to appear on camera.
"When he himself was on the show, prior to our separation, he had no issue at all in consenting to the children’s participating.
"Now that we are separated, the Petitioner refused to allow the kids to partake and has directly threatened legal action against the network.”
RadarOnline.com broke the story: Simon, who divorced Tamra in 2010, refused to allow the children to participate in his ex-wife’s televised marriage to new husband Eddie Judge in June.
The pair share joint legal custody of the children.
Said Tamra: "Petitioner has threatened to sue the network that runs my show, should they allow the children to participate in the show though said participation shall fall within my periods of physical custody.
“These threats have prevented me from exercising legal control over the minor children during my periods of physical custody as the network will not allow the minor children to participate in the filming of the Series due to the Petitioner’s previous threats, without either the Petitioner’s execution of a consent form or finding of this court that I may consent independently.
"The network will not allow our children to participate despite my consent. I have requested that the Petitioner sign an appropriate consent, but he refused.”
The blonde fitness trainer — who joined the OC cast in season three — even told court that the pair’s daughter, Sophia, has “expressed a desire to participate with me” in the series.
“I wish to provide her that opportunity,” Tamra wrote.
“In fact, if our other children express a desire to participate in the future, I would also provide them with that opportunity.”
Tamra's request for court intervention has set the stage for a showdown between the contentious pair, scheduled to be heard in court on December 20.
“I am not requesting any modification to the visitation orders and I am not proposing to infringe on any of the Petitioner’s visitation time,” Tamra wrote in the court request.
"The times that Sophia (or any of the other children) would be filming would be during my periods of physical custody.

“But for Petitioner’s threats to the network, I would not be forced to make this application with the court.
"The existing Judgement does not require that I need Petitioner’s consent to allow the children to participate in the filming of the show.”
Lawyers for Tamra are arguing that under the family code, she may act alone to permit the children to participate in the show, but only during her periods of physical custody.
“The consent of the Petitioner (Simon) is not required,” they argue.
