Real estate tycoon Donald Trump has filed a $5 million dollar lawsuit against Bill Maher for not paying him after the HBO host challenged him to prove that his father wasn't an orangutan,

According to the lawsuit, Maher appeared on Jay Leno's The Tonight Show and was asked about his ongoing beef with Trump.

After accusing Trump of being racist, and that his postings on Twitter were the work of "syphillitic monkey."

Maher then challenged The Apprentice creator, saying: "supposed that Donald Trump had been the spawn of his mother having sex with an orangutan...I hope it's not true..but unless he comes up with proof, I'm willing to offer 5 million dollars to Donald Trump...that he can donate to a charity of his choice...whatever charity!"

During the final days of the 2012 presidential campaign, Trump offered President Barack Obama to provide his college transcripts and in exchange, he would give the Democrat $5 million dollars for a charity of his choice. The President ignored Trump's challenge.

The day after Maher appeared on The Tonight Show, Trump's lawyers sent Maher his birth certificate "demonstrating that he is the son of Fred Trump," who wasn't an orangutan.

The letter demanded that Maher pay the promised $5 million immediately. Trump claimed he would distribute the money to five charities, including the American Cancer Society, March Of Dimes, and the Police Athletic League.

After not responding to follow-up letters, Trump says he was forced to file the lawsuit because his designated charities "have been deprived of millions of dollars in donations."

The Donald is seeking a $5 million dollar judgement, attorney's fees, and a jury trial.
