Jon Gosselin’s former divorce attorney, Charles Meyer, filed an emergency petition Monday to ensure he gets the fees owed to him by Gosselin.

Meyer, who withdrew from the Gosselin divorce in September, claims that Gosselin owes him approximately $43,000 and that Gosselin agreed to pay up from his share of the property division upon completion of the divorce.

Now Meyer wants to ensure he gets paid before Gosselin walks with his share of the cash.

As RadarOnline.com previously reported a divorce arbitrator will divide Jon and Kate's financial assets by December 21, making the finalization of the divorce possible by the end of the year.

A source close to the divorce case told RadarOnline.com exclusively, “I guess Charles Meyers is doing this because he’s afraid he was going to get stiffed!

“Meyers claims he had an agreement with Jon, to the extent that if Jon got any money, he authorized the arbitrator to pay him out of Jon’s distribution.

“That would be off the top of Jon’s distribution. When he heard Jon was going to dispute that, he filed something to enforce the agreement that he believes he had with Jon.

“It doesn’t affect Kate at all. But it’s another classic drama surrounding Jon.

“Listen, lawyers normally don’t get paid this way…all the arbitrator is supposed to do is divide the assets between the parties.

“Now, the courts can award one party to pay counsel fees to the other party.

“But they don’t get involved between the party and their lawyer or, in this case, their previous attorney.

“That’s between the lawyer and the client. In this case, Jon apparently told Meyers that he would get paid directly from Jon’s equitable distribution proceeds.”

When contacted by RadarOnline.com Gosselin’s current lawyer, Mark Jay Heller said, “ I know nothing about it. That lawyer walked off the case. I have not been served. If I get information I will be happy to share it with you.”
