The papers state that on February 16th 2007 Francis obtained a marker from Wynn for $2,500,000. Then on February 18th 2007 obtained a further marker, this time for $300,000. They say that at the conclusion of Francis’ trip to the Wynn in February 2007 he had $800,000 on deposit in his front money account. Wynn applied the $800,000 to his outstanding markers leaving a balance of $2,000,000 due and owing.

According to the papers, shortly after Francis’ February trip he was incarcerated. During his incarceration Francis asked the Wynn to be patient with his outstanding markers and promised that he would honor the debt upon his release. But, upon his release Francis failed to make any payments and instead argued that he should get a discount and that he should be afforded a payment plan, both requests the Wynn refused. Instead they sued Francis for the outstanding balance, plus interest.
